1. OVERVIEW
Reverie Company does business as Moongchi.com. Throughout this Intellectual Property Policy, “Moongchi,” “we,” “us,” and “our” refer to Reverie Company d/b/a Moongchi.com.
Moongchi respects intellectual property rights and expects all users, designers, brands, merchants, and other sellers participating in the Moongchi marketplace (“Sellers”) to do the same.
This Policy describes how Moongchi addresses reports concerning copyrights, trademarks, counterfeit goods, patents, design rights, trade dress, and other intellectual property or proprietary rights.
Moongchi may remove or restrict products, listings, content, or accounts where appropriate under this Policy, our Terms of Service, applicable marketplace policies, or applicable law.
2. PROHIBITED INTELLECTUAL PROPERTY ACTIVITY
You may not use the Moongchi Services to sell, upload, display, distribute, promote, or otherwise make available products or content that infringe or misappropriate the intellectual property or proprietary rights of another person.
Prohibited activity may include:
- Copyright infringement
- Trademark infringement
- Patent infringement
- Design rights infringement
- Trade dress infringement
- Counterfeit goods
- Unauthorized replicas
- Unauthorized use of protected photographs, artwork, graphics, logos, videos, or written content
- Other unauthorized use of intellectual property
Moongchi may also restrict products or conduct that violates applicable marketplace authenticity or anti-copying standards even where the underlying legal dispute has not been finally adjudicated.
3. REPORTING INTELLECTUAL PROPERTY INFRINGEMENT
If you believe that a product, listing, image, design, trademark, or other material available through Moongchi infringes intellectual property rights that you own or are authorized to enforce, you may send a report to:
To help us evaluate your report, please provide as much relevant information as reasonably possible, including:
- Your full name or company name
- Your contact information
- Whether you are the rights owner or an authorized agent
- The type of intellectual property right involved
- Registration or application number, if applicable
- Identification of the protected work, brand, product, or other right
- The Moongchi product or listing URL at issue
- A description of the alleged infringement
- Supporting photographs, comparisons, registrations, authorization documents, or other relevant evidence
- Your physical or electronic signature where appropriate
Incomplete reports may require additional information before we can evaluate or act on them.
4. COPYRIGHT AND DMCA NOTICES
If you believe that copyrighted material available through Moongchi infringes your copyright, you may submit a notification under the Digital Millennium Copyright Act (“DMCA”) to our Designated Copyright Agent.
To be effective under the DMCA, a notification should substantially include:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive copyright right allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, where multiple copyrighted works at a single online location are covered by one notification, a representative list of those works.
- Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient to allow Moongchi to locate the material, such as the applicable product or listing URL.
- Information reasonably sufficient to allow us to contact the complaining party, such as the complaining party’s name, mailing address, telephone number, and email address.
- A statement that the complaining party has a good-faith belief that the complained-of use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the exclusive right allegedly infringed.

5. RESPONSE TO A DMCA NOTICE
Upon receiving a DMCA notice that substantially satisfies applicable legal requirements, Moongchi may act expeditiously to remove or disable access to the material identified in the notice.
Where appropriate, we may notify the Seller, user, or other party that provided the affected material.
We may request additional information from the reporting party if the notice is incomplete or if additional information is reasonably necessary to identify or evaluate the material at issue.
6. DMCA COUNTER-NOTIFICATION
If material you provided was removed or disabled as a result of a DMCA notice and you believe the removal resulted from a mistake or misidentification, you may submit a written counter-notification to our Copyright Agent.
To be effective under the DMCA, a counter-notification should substantially include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location at which the material appeared before removal or disabling.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, together with a statement that you consent to the jurisdiction of the appropriate United States Federal District Court as provided by applicable law and that you will accept service of process from the person who submitted the original DMCA notice or that person’s agent.

7. RESTORATION AFTER A COUNTER-NOTIFICATION
After receiving a valid counter-notification, Moongchi may provide a copy of the counter-notification to the party that submitted the original DMCA notice.
Where required by applicable law, we may inform that party that the removed or disabled material will be restored.
Unless our Designated Agent receives notice that the original complaining party has filed an action seeking a court order to restrain the alleged infringement, Moongchi may restore the material or cease disabling access to it in accordance with the applicable DMCA timetable, generally not less than 10 and not more than 14 business days after receipt of a compliant counter-notification.
8. TRADEMARK REPORTS
If you believe that a product, Seller, listing, brand name, logo, packaging, or other material available through Moongchi infringes your trademark rights, please send a report to:

- Trademark owner information
- Trademark registration number and jurisdiction
- Identification of the protected mark
- The Moongchi listing or product URL
- An explanation of how the use allegedly infringes the trademark
- Relevant photographs or comparison materials
- Authorization information if you are acting for the trademark owner
Moongchi may request additional documentation before taking or reversing action.
9. COUNTERFEIT REPORTS
Counterfeit products are prohibited on Moongchi.
If you believe a product offered through Moongchi is counterfeit, please report it to:
Moongchi may request the Seller to provide evidence concerning authenticity or lawful distribution, including:
- Supplier invoices
- Manufacturer documentation
- Brand authorization
- Licensing documentation
- Product origin information
- Other reasonably relevant authenticity evidence
Moongchi may restrict or remove a listing or Seller account when adequate authenticity information is not provided or when other circumstances reasonably support such action.
10. PATENT, DESIGN RIGHTS, AND OTHER IP REPORTS
Reports involving patents, registered design rights, trade dress, or other intellectual property may also be submitted to:

- Jurisdiction
- Identification of the rights owner
- The allegedly infringing Moongchi listing
- A detailed explanation of the claimed infringement
- Supporting registration, comparison, or other evidence
Because these disputes may involve complex factual or legal questions, Moongchi may request additional evidence or take interim marketplace action while a matter is reviewed.
11. DESIGN COPYING AND MARKETPLACE STANDARDS
As a marketplace focused on designers and brands, Moongchi takes reports of unauthorized design copying seriously.
Where applicable, a design-related report should include:
- Images of the original design
- Images of the reported product
- Specific points of comparison
- Evidence regarding creation or release date
- Sales or publication history
- Registration information, if applicable
- Other relevant supporting evidence
Similarity by itself does not necessarily establish legal infringement.
However, Moongchi may take marketplace action where reasonably appropriate to protect marketplace integrity, brand authenticity, users, or rights holders, including requesting additional information or temporarily restricting a listing while a matter is reviewed.
12. SELLER RESPONSE AND REINSTATEMENT
If Moongchi restricts or removes a Seller’s product or content in response to an intellectual property report, we may allow the Seller to provide relevant information, including:
- Authorization from the rights owner
- License agreements
- Invoices
- Manufacturer documentation
- Authenticity evidence
- Registration or ownership information
- Design creation records
- An explanation of why the reported use is authorized or non-infringing
Submission of information does not guarantee reinstatement.
Moongchi may determine whether to maintain, modify, or reverse marketplace action based on the available information, applicable law, and marketplace policies.
Copyright material removed pursuant to a DMCA notice may also be subject to the statutory counter-notification procedure described above.
13. REPEAT INFRINGERS
Moongchi maintains a policy providing for the restriction or termination, in appropriate circumstances, of Sellers, users, or account holders who repeatedly infringe intellectual property rights.
Depending on the circumstances, actions may include:
- Warnings
- Listing restrictions
- Removal of products or content
- Temporary suspension
- Selling restrictions
- Account termination
Moongchi may consider the nature, frequency, seriousness, reliability, and circumstances of infringement reports and violations when determining appropriate action.
14. FALSE OR MISLEADING REPORTS
Do not submit intellectual property reports, DMCA notices, or counter-notifications that you know contain materially false or misleading information.
Under applicable law, a person who knowingly materially misrepresents that material is infringing or that material was removed or disabled by mistake or misidentification may be liable for damages.
Moongchi may also take action when its reporting process is used for fraud, harassment, retaliation, anticompetitive abuse, or other improper purposes.
15. INFORMATION SHARING
In order to investigate a report, comply with applicable law, or allow an affected party to respond, Moongchi may share relevant portions of a complaint, counter-notification, or related information with:
- The affected Seller or user
- The reporting rights owner
- Authorized representatives
- Service providers
- Government or legal authorities where required
A DMCA counter-notification may be provided to the person who submitted the original DMCA notice as part of the statutory process.
You should therefore understand that information submitted as part of an intellectual property complaint or counter-notification may be disclosed to relevant parties.
16. NO DETERMINATION OF LEGAL RIGHTS
Moongchi’s decision to remove, restrict, restore, or permit a product, listing, account, or other content is a marketplace administrative decision.
It does not constitute a final judicial determination that intellectual property rights have or have not been infringed.
The underlying rights of the parties may ultimately be determined by agreement, applicable law, a court, or another competent authority.
17. REPEAT OR SERIOUS MARKETPLACE VIOLATIONS
Moongchi may take immediate or escalated action where circumstances reasonably indicate:
- Counterfeit activity
- Willful infringement
- Repeated infringement
- Fraudulent documentation
- Attempts to evade prior enforcement
- Use of multiple accounts to continue prohibited activity
- Other serious violations of Moongchi marketplace policies
Such action may include suspension or termination without reinstatement where appropriate.
18. CHANGES TO THIS POLICY
Moongchi may update this Intellectual Property Policy from time to time to reflect changes in:
- Marketplace operations
- Intellectual property practices
- Reporting procedures
- Applicable law
- Regulatory requirements
The current version will be posted through the Services with an updated “Last Updated” date.
